Dock Maintenance Progress
Many docks are neglected and unsafe. A plan to address this has been requested for several years. A new plan is needed.
II. Dock Plan Validity and Procedural Concerns
QSBC's letter references a 2008 dock plan as authority for individual dock ownership and maintenance responsibilities. But we have the following concerns about the validity and proper adoption of this plan:
1) Procedural Compliance
We have found no evidence that the 2008 dock plan was properly adopted in accordance with Article I, Section 9 of the bylaws, which requires 75% approval of all lot owners for matters affecting common elements.
2) Contradiction with Governing Documents
The 2008 dock plan appears to contradict the bylaws and the Declaration of Restrictions and Covenants (2018), which explicitly state that QSBC "reserves title and ownership of all streets, ways, beaches, piers, platforms, docking areas."
3) Selective Enforcement
The purported dock plan has been inconsistently enforced over the years, as evidenced by numerous deteriorated and abandoned docks throughout the common areas.
Given the above contradictions with the current dock maintenance plan, the failure to properly maintain the docks to a safe standard and the inability to hold individual members accountable it seems like time to have the club manage the dock maintenance as originally articulated in the covenants and bylaws.
